As of July 1^st, 2024, the following legislation goes into effect, Assembly Bill 352 (AB 352) & (AB 254)

 This legislation is aimed at mitigating the risk of out-of-state prosecution of individuals seeking abortion services and gender affirming care in California and healthcare providers rendering these services. In totality, this legislation applies to EHR’s, health care providers, health plans, employers, and digital health companies that store, maintain, or handle restricted health information concerning abortion-related services, sexual health, fertility, or contraception.

Beginning July 1^st - based on the following criteria, we will automate marking encounters and charts containing the following information as sensitive and/or block from data sharing with the health information exchange (HIE).

• If there are specific diagnosis codes, medications or procedures your office uses and are not noted below please reply to this email so we can ensure that information is included in the automation.

Encounters with:

The following class of medication: 

1. Contraceptive
2. Emergency Contraceptive and Combinations
3. Puberty blockers: 
   • Goserelin (Zoladex®).
   • Histrelin (Supprelin®LA).
   • Leuprolide (Lupron Depo – Ped®).
   • Triptorelin (Trelstar®)

Procedures related to contraception:

• IUD insertion or removal:   58300, 58301 *J codes for the devices J7300, J7301
• Cervical Cap: A4261, A4266, 57170
• Subdermal implants: 11981, 11982, 11983
• Vasectomy: Z30.2

Diagnosis related to abortion, contraception and gender affirming care:

• History of abortion: Z87.59, Z98.890
• Pregnancy codes: T83.31XA, ectopic pregnancy Z87.59, fetus affected by ectopic pregnancy P01.4
• Gender dysphoria: F64.9, F64.0, F64.8, F66, Z86.59
• H/o gender affirmation: Z87.890
• Encounter for gender affirmation procedure: Z41.8, F64.0
• Transgender status: Z87.890

Demographics:

• Discrepancy with gender: gender at birth and current gender, when there is a mismatch
